As with any sort of modding there is always a ban risk. The actual statistic is unreliable because it's not 100% known if most games, such as Destiny have redundancies that check for modified consoles or not. Typically bans occur when modders are viewed and reported either by game admins or the typical users themselves.
There is no statistic available because a statistic on game bans is unreliable.
some of the factors include, but are not limited to;
popularity of the game,
history of bans from game company (COD as example)
the gamers on said game
etc.
